These terms of use refer to the following additional terms, which also apply to your use of our site:

If you purchase tickets from our site, those tickets are subject to the National Rail Conditions of Travel. 

You are advised to read those conditions which contain limitations and exclusions relating to our liability in respect of loss caused by delays or cancellations. Once you have received your tickets it is your responsibility to check that the tickets issued are accurate. We are only responsible for issuing tickets in accordance with your instructions.

We may revise these terms of use (and any of the other Applicable Terms listed above) at any time by amending this page. Such amendments shall take effect upon the expiry of 30 days after such changes are made or the date upon which you next visit the site (whichever is the earlier).
 
Please check this page from time to time to take notice of any changes we made, as they are binding on you in accordance with this provision.

We may update our site from time to time, and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. 

We do not guarantee that our site, or any content on it, will be free from errors or omissions (including any pricing – in the event of any obvious or clearly accidental pricing error, we reserve the right to amend or change the pricing to the correct price, whereupon, if you still wish to purchase any applicable service or good, you will be required to pay any additional increase (in the event of such obvious or clearly accidental pricing error, or, if you insist on the obvious or clearly accidental pricing error, we may cancel your original purchase, where upon you will receive a refund (together, with, at our discretion, any credit or voucher representing any inconvenience caused).

Our site is made available free of charge.
 
We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.

We may limit the availability of our site at any time and the rail services referred to on our site are  geographically limited. If you choose to access our site from outside the United Kingdom, you do so at your own risk.

Any personal data you upload onto our website, such as when you create an account, will be processed by us in accordance with our Privacy Policy. We are subject to the UK GDPR and are notified to the United Kingdom’s Information Commissioner [under number ZB233679]. 

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. 
 
We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use. 
 
If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us by calling 0345 322 7021.

We cannot be held liable for any damages arising from your disclosure (deliberate of accidental) of your user identification code, password or any other piece of information as part of our security procedures, even if you subsequently notify us of the disclosure or unauthorised access of your account or security information.

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it.  Those works are protected by copyright laws and treaties around the world. All such rights are reserved to either us and/or the applicable third party rights holder.
 
You may print off one copy, and may download extracts, of any page(s) from our site for your personal, non-commercial use and you may draw the attention of others within your organisation to content posted on our site.

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

We do not permit use of our site for business purposes. If you are user who does use our site for business purposes then, please note that in particular, we will not be liable for:

If you are a consumer user, please note that we only provide our site for domestic and private use. You acknowledge that you will be financially responsible for any bookings, which are made through our site using your account details and for all reasonable and foreseeable losses, which we suffer as a result of your breach of these Terms or negligence when using our site (including where you deliberately or negligently let others use your account). You shall not disclose your password or access details to our site to any other person. If you do you will be in breach of these Terms and responsible for all losses that arise as a result of the misuse of your account.

Whilst we endeavour to ensure that our website is secure and free of bugs, viruses and/or any other malware, we are unable to guarantee that our website will be secure or free from bugs or viruses.
 
You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.
 
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
 
If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

It is possible that third parties may gain unauthorised access to our websites and alter its contents as a result of your failing to comply with these terms. To the fullest extent, we cannot be liable for any damages or loss arising out of or in connection with such unauthorised access which arises through your breach. Southeastern excludes all liability in respect of any unauthorised access to the fullest extent permitted by law, arising as a result of your breach.

The site may contain material, including advertising and sponsorship, which originates from third parties. Southeastern excludes, to the extent permitted by law, all liability for any illegality arising from or error, omission or inaccuracy of such material or failure to comply with any relevant law or regulation. It is the responsibility of such third parties to ensure that such material complies with all relevant laws and regulations.

We provide hyper-links from our site to web sites of third parties including other train operators. Please note that we have no control over and are not responsible for the content of linked web sites and accordingly make no warranty or representation as to their contents. Southeastern provides these links for your convenience only but does not necessarily endorse the material on those web sites nor are we in any way responsible for any transaction conducted between you and any such third parties to whose web site we provide a link. Any breach of these Terms shall entitle Southeastern to immediately terminate your use of the site and/or the agreement between us without notice.

We take the issue of data protection very seriously. Our policy is set out in our Privacy Policy, which is located on our website. We may collect information about you while you browse the site if you are a registered user of the site or where you have consented to have our cookies installed on your device. Any personal data processed  by us will be processed in accordance with our privacy policy and the UK GDPR/Data Protection Act 2018. 

If you upload personal data relating to third parties, you confirm that you are lawfully entitled to do so.

It is your responsibility to make sure that any information you provide to  us is accurate and up date. Failure to do so will be a breach of these Terms.

Impartial Retailing

This website offers an impartial service selling an extensive range of tickets around the UK representing all Train Operating Companies. We do not currently support Ferry bookings, supplementary tickets, Sleeper services or Eurostar bookings.

Use of ticket booking

This website is designed to provide you with travel information, to assist you in determining the availability of travel-related goods and services and to make travel reservations or other travel-related purchases.

You agree that you will only use the travel information facilities of this website to find out information for yourself or for another person who intends to use or make use of this website to purchase travel services.

You confirm that you have a lawful authority to use the credit/debit card details you provide to us or our payment services provider for the purpose of settling any payments you owe to us.
You also agree that all information supplied by you in using this website is accurate and that you will not make any speculative, false or fraudulent reservations.
You further agree that you will only use the travel services reservations facilities of this website to make reservations or purchases for yourself or another person on whose behalf you are legally entitled to act.

We shall not be obliged to sell tickets or reserve a set for a person or persons who we have reason to believe may be intending to use it, or the proposed method of payment, fraudulently. We may share your details with relevant law enforcement bodies and credit reference agencies where we believe that you have been involved in a fraudulent purchase.

You acknowledge that you will be financially responsible for any bookings, which are made through the website using your account details and for all reasonable and foreseeable losses, which we suffer as a result of your breach of these terms or negligence when using this website (including where you deliberately or negligently let others use your account).
Please note that Southeastern online discounted sale tickets cannot have further discounts applied to them.

Changes

We pride ourselves on keeping up to the minute in terms of advances in technology and legal developments. As these areas are changing at an ever increasing rate, we request that you refer to the site on a regular basis in order to ensure that you are aware of our most recent Terms, Privacy Statement terms and other policies.

We will do our best to ensure that the site is what we believe to be relevant, up to date and as interesting as possible and we accordingly reserve the right, at our discretion, to make changes to any part of the site.

Issue of tickets

With respect to tickets sold by us, we cannot confirm the price of any tickets until such time as you complete your order and your credit/debit card will not be charged until the order has been processed.

When we have confirmed your booking by e-mail to your registered e-mail address, we will send your tickets or ticket collection number to you using the method you selected when you made your booking.

On receipt of your tickets we would ask that you check to ensure they are correct and contact our Web Customer Care team if your tickets do not meet the information you provided at the time of booking.

Changes, cancellations and refunds

Changes to the date and time of a ticket may be permitted depending on the type of ticket and availability of alternatives, but exchange may not be available for certain ticket types. Changes to Advance tickets will incur a £10 charge per ticket.

Refunds will depend on the type of ticket and conditions applicable to it and may not be available for certain ticket types. If you apply for a refund after the date of travel you will incur a £10 charge.

If the train you intended to use is cancelled, delayed, or your reservation will not be honoured, and you decide not to travel, you may return the unused ticket to the original retailer from whom it was purchased, where you will be given a full refund with no administration fee being charged. Miscellaneous

We may change these terms from time to time; however, any changes will not affect existing terms accepted by you when making a reservation or purchase through this website.

Network Rail usually carries out track maintenance and renewal work at weekends or Bank Holidays, or occasionally early weekday mornings or late evenings.

You are strongly advised to confirm your train times prior to making your journey.

The prices quoted on this website are in Pounds Sterling (£). If you pay for your tickets using a foreign credit or debit card, we are not responsible for the exchange rate and you are advised that changes to your ticket or refunds may be affected by such exchange rate.

If at any time any part of these Terms becomes invalid, illegal or unenforceable in any respect, that invalid, illegal or unenforceable part shall be severed from the remainder of these Terms and the validity, legality and enforceability of the remainder of these Terms shall not be affected or impaired in any way.

Further, the invalid, illegal or unenforceable part will be deemed superseded by a valid, legal or enforceable part that most closely satisfies the intention of the original part. The validity, legality and enforceability of the remainder of these Terms  shall not be affected or impaired in any way.

Whilst we try to provide the most up to date information available, sometimes mistakes can be generated. Southeastern will not be liable for such mistakes and will undertake to improve and/or amend the appropriate systems to correct any such details that are brought to our attention.

You may not assign, sub-license or otherwise transfer any of your rights under these Terms.
 
These Terms cannot be varied except in writing by Southeastern. Nothing said by any employee or agent of Southeastern will be capable of varying these Terms.
 
Failure by either party to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy. Headings in these Terms are for convenience only and will have no legal meaning or effect.
 
The parties do not intend any of these clauses to be enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999.
 
These Terms, the National Conditions of Travel and any specific terms and conditions constitute the entire agreement between the parties.
